End User License Agreement (EULA)
1. General Provisions

1.1. This End User License Agreement (hereinafter referred to as the "Agreement") governs the use of the software and service protektVPN.

1.2. By downloading, installing, or using the protektVPN application, the User confirms full and unconditional acceptance of the terms of this Agreement.

1.3. If the User disagrees with any provision of this Agreement, the User must discontinue use of the service and remove the application from their device.

1.4. This Agreement is entered into between the User and the operator of the protektVPN service, protekt.app ("Company").

2. License Grant

2.1. The Company grants the User a non-exclusive, non-transferable, revocable license to use the protektVPN application for personal, non-commercial purposes.

2.2. The license is valid in all countries where the application is available for download and is limited to the duration of the active paid subscription.

2.3. A single account may be used simultaneously on the number of devices specified by the terms of the selected subscription plan.

3. Account and Service

3.1. The protektVPN service is provided remotely via the Internet. VPN access is a subscription-based service that requires an active paid subscription.

3.2. To use the service, the User must create an account by providing a valid email address and password, or by authenticating through a supported third-party provider (e.g., Google, Apple).

3.3. The User is solely responsible for maintaining the confidentiality of their account credentials and for all activity that occurs under their account.

3.4. The Company reserves the right to suspend, restrict, or permanently delete User accounts at its sole discretion, including but not limited to cases of violation of this Agreement, prolonged inactivity, or suspected fraudulent activity.

3.5. Access to VPN servers and related infrastructure may be subject to technical limitations, including but not limited to server capacity, geographic availability, bandwidth allocation, and the number of simultaneously connected devices.

3.6. The Company may modify, update, or discontinue any aspect of the service, including available server locations and supported protocols, at any time without prior notice.

4. Usage Restrictions

4.1. The User is prohibited from:

  • 4.1.1. Using the service for purposes that violate the laws of the User's or the Company's jurisdiction.
  • 4.1.2. Reverse engineering, decompiling, disassembling, or otherwise attempting to extract the source code of the application.
  • 4.1.3. Reselling, sublicensing, transferring, or distributing access to the service to third parties.
  • 4.1.4. Transmitting malicious code through the service, attacking the infrastructure, or using the service for spam distribution.
  • 4.1.5. Using the service to infringe upon the intellectual property rights of third parties.
  • 4.1.6. Creating multiple accounts to abuse trial periods or the refund policy.

4.2. In the event of violations specified in clause 4.1, the Company reserves the right to suspend or terminate the User's access to the service without refund and without prior notice.

5. Privacy and Data Processing

5.1. The Company collects and processes User personal data in accordance with the Privacy Policy, which forms an integral part of this Agreement.

5.2. By accepting the terms of this Agreement, the User confirms that they have reviewed the Privacy Policy and consent to data processing as described therein.

5.3. The Company does not log, monitor, or store information about the User's network activity while using the VPN connection.

6. Intellectual Property

6.1. All rights to the protektVPN application, including software code, design, trademarks, logos, and other intellectual property, belong to the Company.

6.2. This Agreement does not grant the User any rights to the Company's intellectual property other than the right to use the application within the scope of the license granted.

7. Disclaimer of Warranties

7.1. The protektVPN service is provided on an "as is" basis without any warranties, express or implied.

7.2. The Company does not guarantee uninterrupted or error-free operation of the service, nor its compatibility with the User's hardware or software.

7.3. The Company does not guarantee any specific connection speed, as this parameter depends on numerous external factors.

8. Limitation of Liability

8.1. The Company shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use or inability to use the service.

8.2. The Company's aggregate liability under this Agreement is limited to the amount actually paid by the User for the current subscription period.

8.3. The Company is not liable for the actions of third parties, including internet service providers, telecommunications operators, and government authorities, that may affect the operation of the service.

9. Payment, Subscriptions and Refunds

9.1. Subscription pricing and available plans are listed on protekt.app and in the application.

9.2. Subscriptions may be set to renew automatically at the end of each billing period. By purchasing a subscription with auto-renewal enabled, the User authorizes the Company (or its payment processor) to charge the applicable subscription fee to the User's payment method on a recurring basis until the subscription is cancelled.

9.3. The User may cancel auto-renewal at any time through their account settings, the App Store, Google Play, or by contacting support. Cancellation takes effect at the end of the current billing period; no partial refunds are issued for unused time within a paid period.

9.4. Payments are processed by third-party payment processors (e.g., Stripe, Apple App Store, Google Play). The Company does not store full payment card details and is not responsible for the payment processor's terms, fees, or operational issues.

9.5. The Company reserves the right to change subscription pricing. Price changes do not affect the User's current paid subscription period. The User will be notified of price changes before the next renewal.

9.6. Refund terms are defined in the Refund Policy.

10. Sanctions and Export Control

10.1. The User is solely responsible for ensuring that their use of the protektVPN service complies with all applicable local, national, and international laws and regulations, including but not limited to export control and sanctions laws.

10.2. The service may be unavailable or restricted in certain countries or jurisdictions due to legal, regulatory, or technical reasons. The Company is under no obligation to make the service available in any particular jurisdiction.

10.3. The Company does not guarantee, represent, or warrant that the service will circumvent any network restrictions, censorship mechanisms, or geo-blocking measures. The VPN service is provided for privacy and security purposes.

10.4. The User agrees not to use the service in any manner that would cause the Company to violate any applicable sanctions, export control laws, or regulations.

11. Termination

11.1. This Agreement takes effect upon the commencement of service use and remains in force until terminated.

11.2. The User may terminate this Agreement at any time by deleting their account and the application.

11.3. The Company may terminate this Agreement and block the User's access without prior notice in the event of violations of the terms set forth in Section 4.

11.4. Upon termination of this Agreement, the User's right to use the service is revoked. The provisions of Sections 6, 7, 8, and 10 shall survive termination.

12. Amendments

12.1. The Company reserves the right to amend this Agreement unilaterally.

12.2. The User will be notified of material changes via the application or by email.

12.3. Continued use of the service following any amendments constitutes the User's acceptance of the revised Agreement.

13. Notifications

13.1. The Company may contact the User via the email address associated with their account for purposes including but not limited to: service announcements, changes to this Agreement, billing notifications, and security alerts.

13.2. The User is responsible for maintaining a valid and accessible email address in their account settings.

13.3. Notifications sent to the email address on file are deemed delivered, whether or not the User has actually read them.

14. Governing Law

14.1. This Agreement shall be governed by and construed in accordance with the laws of the United Kingdom of Great Britain and Northern Ireland.

14.2. Any disputes arising in connection with this Agreement shall be resolved in accordance with applicable law.
